BrandCity

Terms of Service

These Terms govern the use of brandcity.lol — the map, the leaderboard, the checkout and everything around them. Using the Service, paying for a spot or completing a payment means you agree to them.

Operator and contact

The Service is operated by Fernando Monja, an individual based in Peru (“we”, “us”, “our”), from brandcity.lol.

Legal, listing and privacy notices: fernandomonjav@gmail.com. If you do not agree with these Terms, do not use the Service and do not pay for a spot. Before checkout you confirm that you have read and agree to these Terms and the Privacy Policy.

What the Service is

BrandCity is an isometric map whose surfaces are paid advertising. Every brand that has paid for a spot is ranked there by the total it has paid for that spot, and the highest ranked are the ones shown. A shop and a walker show one brand at a time; a downtown billboard shows 3, taking turns, and a higher rank gets more turns.

Listings are paid advertisements. They are not editorial picks, reviews, certifications, endorsements or an independent ranking of anything.

A payment is added to your total on that spot and buys whatever rank that total reaches at the moment it is settled. It does not buy traffic, clicks, customers, revenue, search ranking, exclusive placement, a fixed position, a fixed share of the time, or any particular result. Anybody can pay more at any time and rank above you, which lowers your rank and may take you below the number of brands the spot shows. We may change, pause or discontinue any part of the Service, including prices, how many brands a spot shows, the rotation and the leaderboard.

Because somebody may pay while your own payment is being processed, the total you pay may land you at a lower rank than the one shown when you started. The amount you are charged is always the amount shown to you, it is always added to your total on that spot, and it is never refunded for that reason.

Eligibility

  • You must be at least 18 and able to enter a binding contract.
  • If you pay on behalf of a company, you confirm you may bind it, and “you” includes that company.
  • You may not use the Service if you are barred from receiving it under the laws of Peru, the European Union, the United States or any other applicable jurisdiction, including trade sanctions.

Payments, taxes and how a spot is claimed

Checkout is processed by Dodo Payments as merchant of record. They are the seller on your receipt, they collect any sales tax, and the charge on your statement is theirs. Their own terms and privacy notice apply to the payment itself. Full card numbers never reach this Service.

Prices are in US dollars. Getting onto a spot always costs its opening price — from $5 — however many brands are already on it. There is no maximum: you may pay more than the opening, and paying more is what buys a higher rank. Raising a spot you are already on costs at least that same opening price again, and charges only what you add. The exact amount is shown before you pay, and you are never charged more than that amount: if the minimum has moved by the time you press pay, checkout stops and shows you the new one.

Completing checkout is an offer to pay for a spot on these terms. It is accepted when a signed confirmation from the payment provider arrives and the payment is written to the map. What you pay is then added to your total on that spot and buys whatever rank that total reaches at that moment. Because somebody may pay while yours is being processed, that rank can be lower than the one shown at checkout, and it can be below the number of brands the spot shows. Your payment still counts in full towards your total there.

No refunds

All payments are final and not refundable. A spot is a digital service that begins the moment payment is confirmed: it is written to the map and it counts towards your rank within seconds. It is delivered, not pending.

Somebody ranking above you later, landing below the number of brands the spot shows, getting fewer clicks than you hoped, downtime, or a removal for breach of these Terms does not create a refund. What you paid bought the rank it bought.

The one thing that does is a payment that never lands. If a payment is confirmed and it is never added to your total on the spot it was for, it is refunded. The same goes for a duplicate charge, and for a listing taken down for a reason that is ours rather than yours.

By completing checkout you ask us to begin this digital service immediately and acknowledge that you lose any statutory right of withdrawal or cooling-off period to the extent the law allows that waiver. Where a mandatory consumer right cannot be waived, it is honoured.

A chargeback or payment dispute raised without a legally required basis is a breach of these Terms. We may remove the listing and refuse further use of the Service.

What you may put on the map

A product or company website. You may only list an address you own or are authorised to advertise, and you must be able to send visitors there.

Everything shown on your building — the name, the description, the colour and the logo — is read from that site’s own tags at the moment you pay. Nothing is invented and nothing is uploaded.

A listed site must say who is behind it

The destination has to make plain who runs it — a contact page, an about page, a company name, an address, something. Not a form of paperwork: just enough that a visitor arriving from this map can tell who they are dealing with.

A destination that hides who is behind it, or whose details are false or cannot reasonably be checked, may be removed at any time, without notice and without a refund. This is separate from whether the site turns out to be dishonest: not saying who you are is enough on its own.

What is not rented

Refused automatically, at the moment you paste the address:

  • Chat and invite links — Telegram, Discord, WhatsApp and the rest. Link to a page.
  • Shortened links. Addresses are followed to where they actually go, and that is what is stored and shown.
  • Affiliate and tracking parameters. They are stripped from the address before it goes on the map.
  • Adult sites, and sites that describe themselves as adult in their own tags.
  • Sites on a public safety filter, which covers malware and phishing as well as adult content. The address is checked against one at the moment it is pasted.

Beyond that, and whether or not it was refused automatically, you may not list:

  • Anything illegal, fraudulent, defamatory, harassing, hateful, violent, or that exploits children.
  • Malware, phishing, or a site whose purpose is to deceive whoever arrives.
  • Counterfeit goods, unauthorised streaming, or other infringement of somebody’s rights.
  • Offers requiring a licence you do not hold — financial, medical, gambling, weapons and the like.
  • Anything that impersonates another person, brand or company, or claims a spot for a competitor’s site without authorisation.

And you may not interfere with the Service: scraping beyond ordinary browsing, inflating click counts, bypassing rate limits, claiming spots automatically without written permission, or reverse engineering except where mandatory law allows it.

The parks, the streets and the square itself are not for sale — a map where every last tile is for rent is a catalogue, not a city.

What you promise us

By pasting an address and paying, you confirm that:

  • You may list that destination and send visitors to it.
  • The listing and the destination comply with the law that applies to them — advertising, consumer, privacy, intellectual property and any regulated-industry rules.
  • What you submit is accurate, and you will keep it accurate.

Removing a listing

We may refuse, hide or permanently remove any listing, spot or page, with or without notice, where we believe these Terms or the law may have been broken, where a rights holder or a platform complains, or where a listing creates legal, security or reputational risk.

A removal for any of those reasons is not refunded. The one exception is a listing taken down for a reason that is ours rather than yours.

Your place on the leaderboard is ranked by everything ever paid, not by what is held today. Removing a listing does not remove that record.

Other people’s names and logos

To run the map we fetch and display public information about listed sites: the name, the description, the theme colour, the favicon and the address itself. That material is used only to identify the site a paid spot leads to, and to operate and moderate the Service.

Third-party names and marks are used solely to identify the site being advertised. It is not an affiliation with, sponsorship by or endorsement from the rights holder unless the person who paid is that rights holder.

BrandCity, its wordmark and the look of the map are ours. You may not copy the Service, scrape it for a competing product, or use the name in a way that suggests we endorse you. Dodo Payments and other third-party names remain their owners’ property.

The licence you give us

You grant a worldwide, non-exclusive, royalty-free licence to host, cache, reproduce, adapt for display and publicly show the listing and the public material fetched from your site, for as long as needed to run the Service and keep its record. If you want a listing taken down, write to fernandomonjav@gmail.com. A takedown does not undo a completed payment.

Reporting something on the map

If you believe a listing infringes your rights or is unlawful, write to fernandomonjav@gmail.com with: your name and contact details; the address you saw on the map; the destination it led to; what the problem is; and a statement that the notice is accurate and that you are the rights holder or may act for them.

The listing may be hidden while the notice is looked at, and the notice may be shared with whoever paid for it. Repeated or abusive notices may be ignored.

No endorsement, and no promise of results

Appearing on the map is not an opinion about a product. We do not verify that listed companies, claims, prices or results are true. Click counts and visitor numbers describe what the systems recorded; they are not a promise that you will get the same.

Links from the map lead away from BrandCity. Those destinations have their own terms and their own practices, and they are not ours to answer for.

Availability and changes

The Service is provided as is. It may be unavailable, slow or wrong. These Terms, the prices, how many brands a spot shows and the rules of the city may change; if a change is material, the date at the top of this page changes with it. Continued use after a change means you accept it.

For a payment already made, the terms in force at checkout keep applying to that payment, except where a change is required by law or needed to address a security or legal risk.

Disclaimers

To the fullest extent the law allows, all warranties are disclaimed, express or implied, including merchantability, fitness for a particular purpose and non-infringement. There is no warranty that the Service will be uninterrupted, secure or free of errors, or that names, images, positions or click counts are accurate or complete.

Limitation of liability

Nothing here limits liability that the law says cannot be limited, including for intent, gross negligence, or injury to life, body or health. Subject to that:

  • There is no liability for lost profits, lost data, lost goodwill, substitute services, or other indirect, incidental, special or consequential damages.
  • Total liability for any claim is limited to what you paid for the spot the claim concerns, in the three months before the claim.

Indemnity

You will defend and hold harmless the operator of the Service from claims, damages, losses and reasonable legal costs arising from your listing, your destination site, your payment or chargeback, your breach of these Terms, or your infringement of somebody else’s rights. We may take over the defence of such a claim, and you will cooperate.

Governing law

These Terms are governed by the laws of Peru, excluding conflict-of-law rules. To the extent permitted, the courts at our place of residence in Peru have jurisdiction. If you bought as a consumer somewhere with mandatory protections that cannot be displaced, those still protect you.

General

  • If part of these Terms cannot be enforced, the rest stands, and the invalid part is replaced by the closest valid one.
  • Not enforcing something once is not giving it up.
  • You may not assign these Terms without consent; we may assign them together with the Service.
  • These Terms, the Privacy Policy and what you confirm at checkout are the entire agreement.
  • Payment, hosting and infrastructure involve third parties. Their outages and their decisions are outside our control.
